Spousal Support

If the spouses cannot reach a fair and equitable agreement on spousal support, the the court will intervene. In determining whether to award spousal support, the court will consider factors such as the duration of the marriage, the couple’s standard of living during the marriage, each spouse’s income or ability to earn income, as well as their individual needs, assets and financial status.

Parental Responsibility, Time-sharing

Florida law recognizes that each parent has a responsibility to raise their children and an equal right to make legal decisions about their health and welfare. Before a divorce will be granted, the spouses must agree on a parenting plan to establish living arrangements, timesharing (visitation rights) and decision-making rights. Although child support issues can become contentious, we encourage our clients to reach amicable solutions.

Child Support

The state has established specific guidelines for determining child support that consider the net wages of each parent, the children’s medical and educational expenses, as well as the cost of extracurricular activities and health insurance. In Florida, paternity can be established through a Voluntary Acknowledgement of Paternity, marriage and legitimation, an Administrative Order of Paternity, or a paternity lawsuit.
